The seller or the buyer is responsible for the defects of the goods, depending on the reasons for their occurrence and the time when such defects are possible. A lack of goods is a discrepancy between the goods or the mandatory requirements provided for by law or in the manner prescribed by it, or the terms of the contract (and in the absence or incompleteness of the conditions – the requirements usually imposed), or the purposes for which such goods are usually used or about which the consumer informed the seller at the conclusion of the contract, or a sample and (or) the description or sale of goods according to the sample (paragraph 7 of the preamble of the Law of 07.02.1992 N2300-1).
