В другой своей речи Клей процитирует статью, опубликованную в близком к английским правительственным кругам “Quarterly Review” в июле 1817 г., где откровенно утверждалось, что нейтралитет есть не что иное, как «удобный предлог» к последующему признанию независимости Южной Америки – Ibid. Р. 536.

Кстати, один из основоположников международного права Эмерик де Ваттель (1714–1767), к авторитету которого Клей неоднократно взывал, признавал возможность (при соблюдении «огромной осторожности») нарушения принципа невмешательства, если речь идет о борьбе против тирана (его пример – поддержка Нидерландами борьбы против Якова II). Клей указал на действительно спорную проблему тогдашнего международного права. Пытаясь доказать права США на Техас, Адамс отвергал условие uti possidetis 1763 г. (итог Семилетней войны) и ссылался на территориальные притязания Людовика XIV и его земельные пожалования. Если же права на Техас принадлежали Франции, тогда по условиям покупки Луизианы (1803) они переходили Соединенным Штатам.

Иски восходили к событиям 1802–1803 гг.: испано-американский договор Пинкни 1795 г. гарантировал право граждан США на хранение грузов в Новом Орлеане. Хотя по договору Сан-Ильдефонсо 1800 г. Луизиана перешла к Франции, Испания продолжала управлять этой территорией. 18 октября 1802 г. испанские власти запретили хранить грузы – и такое нарушение договора действовало вплоть до покупки Луизианы в 1803 г. К 8 июня 1824 г. законными были признаны 1800 исков на общую сумму почти в пять с половиной миллионов долларов, так что выплаты по каждому из них были сокращены на 8,33 % – Brooks Ph. С. Op. cit. Р. 192. Эти выплаты дали повод ошибочно называть договор Адамса – Ониса «покупкой Флориды».
